All aspects of a legal separation are the same as a dissolution of marriage except the marriage is not terminated.
In a legal separation you divide your bills and property, award custody of children, establish visitation, determine maintenance and child support, just as you would in a divorce. There is no less work to do in a legal separation and you will not save any money in attorney’s fees by going this route.
At any time during the legal separation process if one party wants to change it to a divorce action he or she may do so by a simple motion.
